The terms that apply when you use the WDS Creative website or ask us to quote on, design, build, host or support your project.
Questions
These Terms and Conditions apply to your use of the WDS Creative website (the "website") and set out the general terms on which we quote for and provide our services. By using the website you agree to them. If you do not agree, please do not use the website.
Nothing in these terms limits any right you have under the Consumer Protection Act 68 of 2008 ("CPA") or the Electronic Communications and Transactions Act 25 of 2002 ("ECTA") that cannot lawfully be limited.
Some clauses limit our liability or place responsibilities on you. As the CPA requires, we draw your attention to them: Information on the website, Limitation of liability and Indemnity.

WDS Creative designs and builds websites, ecommerce stores and custom software, provides deployment, hosting and IT services, offers search engine optimisation, marketing, branding and graphic design, builds automation and AI workflows, and licenses its own software products, which are listed on this website. Each software product may have its own licence or subscription terms.
You may use the website for lawful purposes. You may not:
We take care to keep the website accurate, but service descriptions, portfolio examples, product features and prices may change or contain errors. Portfolio and product examples are for illustration. Please confirm anything that matters to your decision with us before you rely on it.
The website and its content, including text, graphics, logos, design and code, belong to WDS Creative or its licensors and are protected by copyright and trade mark law. You may view and print pages for your own use, but you may not copy or reuse our content for any other purpose without written permission. Ownership of work we create for clients is set out in each project agreement.
The website links to websites we do not control, such as LinkedIn and Facebook. Projects may rely on third-party services, such as hosting platforms, domain registrars, payment gateways and plugins. Those services have their own terms, and we are not responsible for their content, availability or practices.
The website is provided "as is". To the extent the law allows, we are not liable for any loss or damage arising from your use of the website, from it being unavailable, or from your reliance on information on it, unless the loss is caused by our gross negligence or wilful misconduct. Our liability for services is set out in the relevant project agreement. This clause does not limit any liability that cannot be limited under the CPA or other law.
You indemnify WDS Creative against any claim, loss or cost arising from your breach of these terms, your unlawful use of the website, or materials you provide that infringe someone else's rights.
We handle personal information as our Privacy Policy and the Protection of Personal Information Act 4 of 2013 describe. Our Cookie Policy explains the cookies and browser storage we use, and our PAIA Manual explains how to request access to records.
You agree that we may communicate with you electronically. Agreements, notices and other messages we send electronically meet any legal requirement that they be in writing. A message counts as received when it reaches your email or other information system and you are able to retrieve it.
If you have a complaint, please contact us first at hello@wdscreative.biz so we can try to resolve it. Consumers may also refer a dispute to an alternative dispute resolution agent, the National Consumer Commission or another body with jurisdiction. These terms are governed by the laws of the Republic of South Africa, unless your project agreement says otherwise.
